MA: Groups challenge obscenity law scope

“A coalition of Internet content providers and free-speech advocates told a federal judge yesterday that a new Massachusetts law aimed at protecting children from online sexual predators effectively bans anything that may be considered ‘harmful to minors,’ including material that adults have the right to view. Supporters say the new law closes a loophole that led the state’s highest court to overturn the conviction of a man accused of sending sexually explicit instant messages to someone he believed was a 13-year-old girl. The Supreme Judicial Court found that the old state law that imposes criminal penalties for disseminating material harmful to minors did not cover electronic communications.” (10/20/10)

Anti-abortion group: “Lies” about candidates should be legal

“A national anti-abortion group, the Susan B. Anthony List, has filed a lawsuit over a state election law that prohibited the group from putting up a billboard against a Democratic congressman, according to the Associated Press. The group claims Rep. Steve Driehaus (D-OH), a first-term anti-abortion Democrat, ‘voted for taxpayer funding of abortion,’ because he voted for the new healthcare laws. The planned billboard would have read, ‘Shame on Steve Driehaus! Driehaus voted FOR taxpayer-funded abortion.’ Driehaus denied the claim and filed a complaint with the Ohio Election Commission. The commission ruled in Dreihaus’ favor, saying that there was probable cause that the planned billboard included false statements.” (10/20/10)

WI: Freedom Rally draws 500 in search for information

“There were almost as many hip-holstered guns as there were American flags flying at the Southern Wisconsin Pre-election Freedom Rally on Janesville’s north side on Saturday. In the end, it wasn’t just about guns. Or taxes. Or the nation’s health care system. Or even ‘tea,’ really. About 500 people turned out for the rally … The event included issue-oriented information booths and speeches from local, state and national politicians running in the November midterm election. Organizers of the Freedom Rally are members of the Southern Wisconsin Patriot Alliance, a group of activists associated with the ‘taxed enough already,’ or Tea movement.” (10/18/10)

NC: Elementary student brings pot to school to turn in his parents

“Two parents are facing drug charges after their child took their drugs to school and told a school officer his parents were breaking the law. … The 11-year-old student is in 5th grade at a an elementary school in Matthews. Police say he brought his parents’ marijuana cigarettes to school when he reported them. Matthews Police say he reported his parents after a lesson about marijuana was delivered by a police officer who is part of the D.A.R.E. program, which teaches kids about the dangers of drugs, alcohol, and tobacco. … Police say both the 11-year old and a sibling have been removed from the parents’ house by social services. Siegfried Rotthaeuser and his brother-in-law have come up with a legal way of importing and distributing 75 and 100 watt light bulbs — by producing them in China, importing them as ’small heating devices’ and selling them as ‘heatballs.’” (10/15/10)

Gay couples take on immigrant divide

After they exchange vows, Greg Gould and Aurelio Tine will immediately go to battle with the US government. Gould said he will formally apply for legal residency for Tine, a native of Venezuela, even though he fully expects to be rejected, to lay the groundwork for a possible legal challenge to a federal law they say discriminates against gays. The US government offers a path to legal residency for immigrants who marry Americans, but it does not recognize same-sex marriages. “Baton-toting police have stormed the Acropolis clashing with government workers and blocking Greece’s most sacrosanct archeological site for a second day. The scuffles, watched by astonished tourists, erupted when police burst into the grounds of the landmark attraction through a side entrance. Protesters clung onto the gates, defying repeated orders to clear the entrance. At least 30 government workers had occupied the Acropolis overnight, barricading themselves inside and changing the padiock on the main gate to keep police out.” (10/14/10)

SC: Man fights to keep religious signs on his property

“A South Carolina man says his constitutional rights have been violated after he was told by his local government to remove the Bible-themed signs he had posted on his property. Oscar Moultrie says a Berkeley County, S.C., ordinance that requires residents to obtain government permission before putting up signs on their private property — other than ‘for sale,’ ‘for rent,’ political signs and a few other exceptions — violates his First Amendment right to freedom of speech and freedom of religion. Moultrie says he received no complaints about his signs before the county ordered him in March to remove them or pay $25 to get a permit to post them.” (10/11/10)

“Open carry gun rights supporters met Saturday on public fishing piers in Tampa and Daytona Beach, FL for a morning of fishing and to exercise their right to bear arms. The Florida Open Carry movement started holding open carry & fishing events immediately after the United States Supreme Court clarified that the Second Amendment protects a fundamental right for the individual to keep and bear arms for self defense. The high court also held that the Second Amendment is incorporated to the states. This requires that state and local governments protect your right to own and carry firearms without undue restrictions. Serbia: Violence mars gay pride parade

NY: FBI seizes John Lennon fingerprints before auction

“A set of John Lennon’s fingerprints being auctioned for at least $100,000 was seized by the Federal Bureau of Investigation on Wednesday 30 years after the singer’s death. … The fingerprint card was being shown to media at a midtown New York store early Wednesday in an auction preview of more than 90 Beatles items when the FBI faxed a subpoena there and took the card. Lennon was born in Liverpool, England and had been investigated by the FBI in the early 1970s for anti-war activity. … ‘We’re investigating how the item came to be in a private collection,’ FBI spokesman James Margolin said. ‘It is apparently a government document and would not normally be in the commercial stream.’” (10/07/10)

NC: ACLU sues school over nose-piercing suspension

“The American Civil Liberties Union claims in a lawsuit filed Wednesday that a North Carolina school violated the constitutional rights of a 14-year-old student by suspending her for wearing a nose piercing. The lawsuit from the state chapter of the ACLU seeks a court order allowing Ariana Iacono to return immediately to Clayton High School, which has kept her on suspension for four weeks since classes started. The complaint hinges on Iacono’s claim that her nose piercing isn’t just a matter of fashion, but an article of faith. She and her mother, Nikki, belong to a small religious group called the Church of Body Modification, which sees tattoos, piercings and the like as channels to the divine.” (10/06/10)

MD: Motorcyclist wins taping case against state police

“A Harford County Circuit Court judge ruled this afternoon that a motorcyclist who was arrested for videotaping his traffic stop by a Maryland State Trooper was within his rights to record the confrontation. … The judge ruled that Maryland’s wire tap law allows recording of both voice and sound in areas where privacy cannot be expected. He ruled that a police officer on a traffic stop has no expectation of privacy. ‘Those of us who are public officials and are entrusted with the power of the state are ultimately accountable to the public,’ the judge wrote. ‘When we exercise that power in public fora, we should not expect our actions to be shielded from public observation.’” (09/27/10)

“Gun-rights group Wisconsin Carry is accusing the city of Madison and police Chief Noble Wray of violating the Second Amendment rights of five men. A federal lawsuit filed Wednesday says officers violated the rights of five armed patrons at a fast-food restaurant by asking them to produce identification or face arrest. CA: Guns cleared for Hometown Fair

That scenario seems to be playing out right now as what is possibly the mother of this midterm election’s Washington rallies slips into town under what Harry Potter fans might call an invisibility cloak. A group called One Nation Working Together, which bills itself as ‘a nationwide liberal organization dedicated to networking progressives together for true hope and change,’ has been planning its big event for Oct. 2 since May. … Yet, punch in ‘Washington rally’ for a Google search and all you hear about is the upcoming Stephen Colbert/Jon Stewart event on Oct. 30 — or lingering deconstructions of the Aug. 28 Glenn Beck gathering on the steps of the Lincoln Memorial.” (09/28/10)

Protesters arrested outside White House

“More than 100 people protesting mountain-top removal coal mining were arrested Monday outside the White House for failing to obey an order to disperse, the U.S. Park Service said. All 114 people arrested at the protest against mountain-top mining were later released pending a court date, according to the park service. The protesters, most from the Appalachian coal-mining states, had a permit to gather in front of the White House, but some failed to follow rules set out in the permit, according to a park service spokesman.” [editor’s note: The only “permit” anyone needs is the First Amendment’s assembly clause, and the only rule it implies is that the assembly be peaceable. LA: Three years for New Orleans ex-cop in post-Katrina bridge shooting

“A former New Orleans police detective who admitted he helped cover up deadly shootings of unarmed residents on a bridge after Hurricane Katrina has been sentenced to three years in prison. Jeffrey Lehrmann, one of five former officers who have pleaded guilty in the Justice Department’s probe of the Danziger Bridge shootings, was sentenced Wednesday by U.S. District Judge Lance Africk. Africk refused a prosecution request to postpone Lehrman’s sentencing until after six current or former officers are tried. Africk also went above the sentencing guidelines, which called for up to six months behind bars.” (09/22/10)

Germany: Restaurateur in hot water over giant schnitzels

“A German restaurant operator has run into trouble with local tax authorities because he makes larger-than-average schnitzels — or veal cutlets — for his customers in a working class section of Saxony. Gerhard Kaltscheuer said his giant schnitzels are popular in the town of Hammerbruecke and he sells about 70 dishes per day. FL: 84-year-old vet suffers broken neck after police takedown

Ireland: Police to send “test” youths to pubs

“Ireland plans to allow police to send ‘test’ youths to pubs from next month to check if landlords abide by laws prohibiting the sale of alcohol to those under 18, Justice Minister Dermot Ahern said on Tuesday. Faced with one of Europe’s worst binge drinking cultures which usually starts in teenage years, police will be authorized from October 1 to get permission from parents to train and send young people aged 15-17 to licensed premises. If any alcohol is sold to the minors, the pub will be prosecuted and face fines or closure for a period.” (09/21/10)

Montana GOP policy: Make homosexuality illegal

FL: Child still expelled for toy gun — one year later

“Samuel Burgos has fond memories of his friends at school, but he only gets to see them in pictures now. The 8-year-old boy hasn’t been in school for a year and will likely miss another year if the Broward County School Board has its way. Burgos was suspended from school in November after a teacher found a toy gun in his backpack. But when the boy went to register to go back to Pembroke Pines Charter School, he was told he will be expelled for this school year, too, as part of the county’s zero tolerance weapons policy. ‘He made a mistake, but why the severe punishment? I don’t understand that,’ said Magdiel Burgos, Sam’s dad. School board officials said the rules are quite clear and that the toy gun constituted a weapon.” (09/17/10)

“New York City is pursuing a tough new policy that would shoo smokers out of public parks, beaches, and even the heart of Times Square — one of the most ambitious outdoor antitobacco efforts in the nation. Celebrated civil rights photographer was FBI informant

“Ernest Withers had seen it all. Described as the ‘original civil rights photographer’ he was present at some of the most important events during the movement. He snapped photos at the murder scene of Dr. Martin Luther King Jr. and the Little Rock crisis. Little did his subjects know that he was doing some other work on the side. Memphis Commercial Appeal has revealed that Withers, who died in 2007 at the age of 85, worked as a paid FBI informant. The newspaper possesses numerous reports that show Withers was spying on King and other activists, including the day before his murder when he met with what the FBI thought were black militants.” (09/14/10)

She has been arrested nine times for trespassing at the Vermont Yankee nuclear power plant. “A German dairy farmer has come up with a novel way to drum up new business — he opened a ‘milk filling station.’ The ‘Milchtankstelle’ near Cologne in the town of Neunkirchen-Seelscheid dispenses the output of 78 cows from a stainless steel vending machine. Customers can either bring their own empty containers or buy milk bottles to fill up. … ‘Customers say that the milk on sale in supermarkets doesn’t taste good any more,’ he said. ‘Supermarkets work on improving the shelf life, but people just want fresher milk. “The New Orleans Police Department is reeling from allegations of murder, conspiracy and civil rights violations in the chaotic days following Hurricane Katrina. When the storm hit dozens of police abandoned their posts. CBS News cameras caught others apparently looting stores. More than 500 officers were fired or disciplined for their actions. Sherrel Johnson’s son, 17-year old James Brissette, seen here in the only photo to survive the storm was shot six times by police while crossing the Danziger bridge five days after the storm. GA: Judge refuses to block ban on guns in church; case moves forward

“A federal judge on Monday declined to block enforcement of a new Georgia law that bans guns in places of worship. ‘It’s not at all discouraging,’ said John Monroe, the attorney who filed a lawsuit on behalf of a minister at a Thomaston church and GeorgiaCarry.org, gun-rights advocacy group. U.S. District Judge C. Ashley Royal, in a 30-minute hearing, said he would base his final decision on the outcome of the lawsuit only on the writings submitted by Monroe and the attorney for the state and Upson County …. Royal’s ruling on the case likely won’t occur this summer. Whatever his decision, legal analysts expect it to be taken to the 11th U.S. Circuit Court of Appeals, and eventually to the U.S. Supreme Court.” (08/23/10)

“Minneapolis will pay seven people who were jailed after a street theater protest. The Minneapolis city attorney’s office has decided to pay seven zombies and their attorney $165,000. The payout, approved by the City Council on Friday, settles a federal lawsuit the seven filed after they were arrested and jailed for two days for dressing up like zombies in downtown Minneapolis on July 22, 2006, to protest ‘mindless’ consumerism. When arrested … most of them had thick white powder and fake blood on their faces and dark makeup around their eyes. They were walking in a stiff, lurching fashion and carrying four bags of sound equipment to amplify music from an iPod when they were arrested by police, who said they were carrying equipment that simulated ‘weapons of mass destruction.’” (08/23/10)

Kashmir: Six hurt in fresh clashes

“Six people were hurt Sunday when police fired pump action shotguns at stone-throwing protesters in Kashmir, where more than 60 people have died during anti-India protests. Police said the incident took place in Srinagar, the main town in Indian Kashmir, when police were conducting a flag march. ‘Some miscreants pelted stones heavily on the police. The police used (teargas) and pump action ammunition to chase them away,’ a police statement said, adding that six people were hurt. Doctors said one was in a critical condition. DC: FBI police harass student for photographing “sensitive” area

“Jerome Vorus, who is becoming a full-fledged photo rights activist while still in his teens, had yet another confrontation Friday over his photography. The 19-year-old college student was taking pictures outside the J. Edgar Hoover Building in Washington DC when an FBI police officer ordered him not to take her photo. First he turned on the video camera on his cell phone. Then he informed her that that she didn’t have an expectation of privacy. ‘I wasn’t even taking her photo in the first place,’ he said in a phone interview with Photography is Not a Crime. As he was walking away, another FBI cop pulled up in a car and ordered him to stop.” (08/14/10)

Because when the Multnomah County Health Department officials came through cracking down on lemonade stands and other fly-by-afternoon ‘food establishments’ wildly flouting the rules requiring a $120 temporary restaurant license, they told Julie and Maria to stay put. MI: Marysville changes firearms ordinance

“A Marysville ordinance banning firearms from parks has gone against state law for more than 20 years. However, that ordinance has been amended since city officials were educated about Michigan’s open-carry law by two men flexing their rights at Marysville Days in June. The ordinance previously barred any person from carrying firearms … within any public park without special permission. … The City Council voted Monday to remove the word ‘firearms’ from the ordinance … City Manager Jack Schumacher said the city attorney reviewed the municipality’s ordinances after it was found that the two men — Rob Harris and Scott Webb — had the right to carry holstered firearms in the city park.” (08/11/10)

Families can’t send tobacco to soldiers overseas

“Family and friends have suddenly found themselves blocked from shipping cigarettes and other tobacco products to American troops in Afghanistan and Iraq because of a new law meant to hamper smuggling and underage sales through the mail. The Prevent All Cigarette Trafficking Act of 2009 quietly took effect June 29. CA: Photojournalist wins settlement after frightening altercation with police chief

“An Oakland Tribune photojournalist is now $99,000 richer thanks to the jackass who was school district police chief at the time. In November 2008, Jane Tyska was covering an immigration demonstration when Oakland School District Police Chief Art Michel side-swept her with his car. Michel then stopped the car, jumped out and began threatening to arrest Tyska for hitting his car with her elbow. That’s right, her elbow. You really have to hear the exchange in the above video to believe it.” (08/07/10)

FL: Wet t-shirt leads to arrest

“A Lake County mother was arrested at a children’s splash park after her white shirt got wet. Now, she’s suing the city of Tavares over her arrest. … A park employee asked Lovett to leave, because the white t-shirt she was wearing had become wet and her padded bra was showing. She says she left, but outside the park gate a police officer approached her and asked her for ID and her name. … The police report indicates Lovett didn’t give her name fast enough. The mom says she was scared and wanted to know why she was getting arrested. Lovett’s attorney, Howard Marks, is demanding those same answers from the city. He says the police had no legal right to ask Lovett for ID, because no crime had been committed.” (08/05/10).

VA: Activists rally to free Bradley Manning

“Activists rallied outside the Marine Corps base at Quantico, Virginia, Sunday to applaud the man military officials suspect leaked scores of military documents to the WikiLeaks website — a 22-year-old Army private named Bradley Manning. … Outside the Quantico gates, about 80 protesters chanted ‘Bradley Manning told their tale, war criminals off to jail’ and held signs calling on the military to ‘Free Bradley Manning.’” (08/08/10)

Feds admit storing checkpoint body scan images

“For the last few years, federal agencies have defended body scanning by insisting that all images will be discarded as soon as they’re viewed. The Transportation Security Administration claimed last summer, for instance, that ’scanned images cannot be stored or recorded.’Now it turns out that some police agencies are storing the controversial images after all. The U.S. Marshals Service admitted this week that it had surreptitiously saved tens of thousands of images recorded with a millimeter wave system at the security checkpoint of a single Florida courthouse.” (08/04/10)

OH: Cops attempt to justify arrest by calling themselves cowards and idiots

“A woman in Ohio using her cell phone to videotape police questioning her boyfriend caused deputies to fear for their lives because she could have easily been holding a ‘cell-phone gun.’ … Melissa Greenfield, the 115-lb, 20-year-old woman was wearing a neck brace when she began videotaping deputies talking to her boyfriend at a truck stop. She was charged with obstructing official business and resisting arrest, which are common contempt-of-cop charges. Greenfield say when deputies returned her cell-phone, she discovered they had deleted her videos. However, the sheriff says they did no such thing because that would have required a warrant.” (08/03/10)

VT: ACLU seeks records in racial profiling case

“It’s a case that is raising questions about racial profiling by police, whether a town is improperly hiding what should be public records, and whether cash-strapped media outlets should take free legal help from a group that frequently takes sides in issues they cover. The circumstances have been likened to those last year involving a Cambridge police officer and Harvard professor Henry Louis Gates, Jr.. In this case, the trouble began May 29, when a cleaning firm employee called police in Hartford to report that a condo she had been hired to clean appeared to have been ransacked and burglarized.” (08/03/10)

UK: Sex job ads banned at employment offices

“Britain is to ban employers looking for lap dancers, strippers, topless barmaids or sexy web-cam performers from placing adverts at Jobcentres. Such a ban had previously been in place at the taxpayer-funded employment exchanges but that changed seven years ago when Ann Summers, a sex toys and suggestive lingerie retailer, successfully argued at the High Court that it was unlawful.” (08/02/10)
