But the donation turned out to be an expensive hoax that may force the charity to cut back on winter assistance for the needy. Investigators said yesterday that more than a dozen Charleston-area charities received fake checks before Christmas purporting to be gifts from a genuine local company. None of the other charities cashed theirs, but the Salvation Army deposited its check. It went ahead and spent some of the money on food and toys for about 100 families, counting on the check to clear. At issue in the hour-long oral argument was whether a ruling by the Florida Supreme Court had so significantly changed the substance of Florida property law as to amount to a public taking of private property without payment of just compensation. Tallahassee lawyer D. Kent Safriet told the justices that Florida’s highest court ‘redefined’ the essence of littoral property rights in the state … [and] determined that the essential right for waterfront property owners was access to the water, not physical contact with it. Bush issued the threat after Senate Majority Leader Bill Frist and House Speaker Dennis Hastert publicly criticized the deal and said a thorough review was necessary to ensure that terrorists could not exploit the arrangement to slip weapons into American ports. This surveillance clearly violates both the Fourth Amendment and criminal statutes that prohibit unauthorized electronic surveillance. But only one group has the power to get to the bottom of this scheme to invade Americans’ privacy: the United States Congress. There is already bipartisan support on the Hill for such an investigation, but it needs shoring up. Since August 8, the number of detainees refusing food has slowly increased from several dozen to 128, according to the Pentagon.
