McCarthy’s Assault Weapons Ban and Law Enforcement Protection Act of 2007, (H.R. 1022), would reenact the ban for ten years. Merterries, 15, was a student at Forrest Hills Academy, an alternative school for middle and high school students with discipline problems, according to an Atlanta police report. Von Pohle asked Eber why and Eber became violent, telling Von Pohle he was going to kill him. During that exchange, Shelton attacked Von Pohle, striking him with closed fists and slamming his head into a parked car. Von Pohle attempted to fend off the attack but realized Eber was closing in on him as well. Von Pohle drew his concealed 9mm revolver (for which he had a weapon permit) and pointed it at both subjects telling them if they came any closer he would shoot. The suspects stopped their advance. The shootout happened at the All Family Chiropractic Center in Pine Hills and, with bullets flying into a busy street, investigators said it’s amazing no one was hit. The suspects never got to fill their U-Haul with any loot. Earlier this year, Wal-Mart told fishing tackle suppliers that their gear — like fabrics and other ‘rural products’ — might be removed from some stores altogether, or at least be stocked only seasonally. That doesn’t mean Wal-Mart is getting out of the fishing business, company executives said. Nor is the company turning its back on hunters, they added. But recently, Wal-Mart joined New York mayor Michael Bloomberg at a gathering of his group, Mayors Against Illegal Guns, to announce a series of changes to the way the company handles firearm transactions. In the future, firearm purchases at Wal-Mart will involve a video record of the sale, which the store will keep on file as a database of gun buyers. Employees also will be given the discretion to deny firearms sales to anyone who’s had a firearm traced by the Bureau of Alcohol, Tobacco and Firearms for any reason. Randy Owens, 42, said he fired a shot into an old furnace so the burglar would know he wasn’t holding a BB gun. He said he did not shoot at the burglar. … Owens heard a garage alarm about 5:30 a.m. and went to investigate. A side door had been kicked open; it had the outline of a large footprint on it. The lock was broken. When he entered his shop, Owens said he noticed someone under one of his tables. Police said in a report: ‘He told the suspect to come out and a verbal argument ensued. As they argued Randy stated that he drew his 9 mm handgun. The suspect lunged forward, striking Randy in the forearm with a cane.’ Owens said the man pleaded with him to let him go. Owens tried to hold him in the garage until police arrived but the man kept coming at him and Owens allowed him to get away. The robber broke into the store in the 100 block of Roberts Cut Off Road in West Fort Worth and terrorized the woman who was working there, police said. Modeled after a law passed in 1987 by the Oklahoma Legislature, and a similar one in Florida years later, the Georgia version has been tweaked and amended in recent years. Instead of justifying the use of deadly force only when the intruder makes a ‘violent and tumultuous’ entrance that causes the resident to expect to be assaulted, or causing the resident to believe that the intruder is about to commit a felony, Georgia in 2001 added a section to its defense of habitation law authorizing use of deadly force against any intruder — not a family member — who forcibly enters a residence. ‘It does give (a resident) a little more leeway to defend himself without having to ask so many questions,’ said University of Georgia Law Professor Donald E. Wilkins Jr. ‘You shouldn’t have to ask questions of intruders and then shoot to protect yourself. Officer Micheal Hoover knows a fair amount about guns as a sniper instructor for a Tennessee SWAT team. He recalls the night two years ago when a car pulled up beside him on a highway and the passenger waved what looked like an Uzi. ‘It scared me,’ he said. ‘If anyone is in their right mind, I don’t see how it wouldn’t.’ Hoover was off duty and called for police help. Police say the incident happened around 3:00 a.m., Friday, May 9, 2008, on Parakeet Drive in the Westwood area of Memphis. The owner of the burglarized SUV says he and his wife woke up to the sound of a big crash and his dogs barking. The man went outside to find out what was going on, and discovered a crook dangling from his SUV trying to steal items from inside. According to the vehicle’s owner, he repeatedly told the accused car burglar to get out of the SUV. He says he was not able to see the burglar’s hands and did not know if the suspect had a weapon, so he shot the crook in the buttocks. Soon after, Rozio started bringing a gun on his sales runs, which took him and his priceless jewelry to shops across South Florida. About 12:45 p.m. Wednesday, not long after Rozio parked his red Ford Explorer outside St. Moritz Jewelers on Boca Raton’s west side, four men screamed up behind him in a silver car, boxing him in. They surrounded the Explorer, smashing out all four windows to get at the jewelry inside, witnesses said.’ ‘He opened up like I have never seen,’ said Greg Sanderson, manager of a nearby Omaha Steaks shop, who watched the shooting through the store’s plate-glass windows. ‘I couldn’t believe it. Police were called to a burglary in progress at 7:43 p.m. Monday to 1350 Knox Road 600E. According to police, the resident was in his basement when he heard a knock at the door. When he got to the main floor, he saw two unidentified men on the rear deck. The resident returned to the basement and retrieved a handgun. The resident went upstairs and found the two men standing inside his home. The suspects fled and the resident followed, eventually firing a warning shot into the ground. One of the suspects stopped while the second suspect continued running. Tyrone L. Chief Dave Hansen was taken to McKay-Dee Hospital in Ogden for surgery. The 54-year-old chief accidentally fired a gun during a training exercise inside a conference room at Riverdale police headquarters. A fire captain and Riverdale Mayor Bruce Burrows confirmed the chief shot himself Saturday in an ankle bone. They said he was trying to fix a gun with a jammed round when the bullet fired. The 30-year-old suspect, shot several times by a clerk at Mesa Mart, 1510 S. Country Club Drive, was listed in critical condition at Scottsdale Healthcare Osborn, police spokeswoman Detective Chris Arvayo said. Although the 55-year-old clerk had been assaulted with a pipe, he did not require extensive medical attention. … The incident began about 8 a.m., when the suspect entered the store near U.S. 60. He then demanded money while striking the clerk with a pipe. The clerk first used a Taser, but it did not stop the robber. Police Sergeant Vince Valdez says officers were called to El Zacatecas Club before three A.M. where a brawl was underway outside a video store next door. Valdez says: ‘When the officers arrived they found two men down on the ground struggling in the parking lot of the video store. Both were injured.’ He says officers had to determine who was who in the situation very quickly. Valdez says the bar’s owner, Martin Ramirez, was holding down the second man, claiming that man had tried to rob him along with another man who was still in the bar. Officers went inside and found a badly wounded man who had been shot. Chief Deputy Sheriff James Bauman said Dr. Don Johnson, who operates Willow Tree Dental in Lakeport, does not face charges following the shooting of his wife, Margaret Johnson, during an incident at his Kelseyville home late Friday. … Don Johnson told investigators that after he had gone to bed, he heard a woman screaming outside the home. He said he reached for a handgun and was calling the Sheriff’s Department when he heard the sound of glass breaking at the rear of the house. He said that when investigating the sounds, he saw his wife entering the house armed with a pickax. The new rule says park visitors would need a permit to carry a concealed weapon, and the state where the park is located must allow guns in its own parks. Concealed weapons are allowed in Washington’s state parks. Current regulations require weapons to be temporarily inoperable or stowed so they are not easily accessible. Secretary of the Interior Dirk Kempthorne announced the proposed change. But the suspect, who may have been hit, was able to get away. … Police said a company employee had been sleeping in an apartment inside the business when he heard a loud crash coming from the garage area. The employee grabbed a 12-gauge shotgun and went to the garage area to investigate. The employee saw the garage door partially open and then saw a man inside near one of the company’s trucks. The injured man, who suffered wounds that were not life-threatening, was shot by an irate homeowner who told officers he gave chase and fired after somebody tried to break into his vehicle, police said. There were no immediate arrests as investigators gathered evidence and tried to determine whether the shooter, under the facts of the case, was justified in using deadly force, said Detective Stacie Derge, a Phoenix police spokeswoman. … The homeowner told police that his car alarm sounded and he stepped outside to see what was happening. He said somebody tried to break into his car and he saw a man walking away from the vehicle. The suspected auto burglar stepped into a pickup truck and drove away, while the homeowner got into his vehicle, a Pontiac, and gave chase, following the man through surrounding neighborhoods. It’s designed to clarify a law allowing Missourians to carry concealed weapons. That law allows businesses to bar guns from their premises. It has sometimes been interpreted to include parking lots. Bill supporters say it’s possible for Missourians to be barred from taking their gun into a store and prohibited from leaving it in a vehicle while they shop. Employers could still prevent employees from having a gun in company-owned vehicles. A man and his girlfriend were returning to their Middle Village apartment about 4:50 a.m. when they were confronted by three men, police said. According to the victim, the men forced the couple into the apartment, where they tied them up with plans to rob the place, cops said. Somehow, the victim was able to get loose and grab a gun one of the suspects had left unattended, he told police. He shot one of his attackers in the head, killing him. Two suspects are in custody for one of the robberies, and are undergoing questioning. In the last of the three, shots were fired. One of the store clerks exchanged gunfire with the robber. The bullet pierced a metal cabinet wall and struck Hung Ngyn in the leg. Ngyn, 42, is being released from the hospital and is said to be doing well Friday. Two men, one with a gun, went into Gerk’s Party Works on 36th St. around 11:15 p.m. and demanded money. That’s when the exchange of gunfire took place. Police aren’t sure if anyone was hit. James William Spiers III, 38, said Pizza Hut officials asked for his resignation in exchange for at least two months’ pay and counseling. ‘I was terminated, but they’re not going to kick me to the curb,’ he said. ‘When they terminated me, I had asked I they could provide me with counseling. That’s all I asked for.’ Spiers fired multiple shots at a man who allegedly put a gun to his head on March 28 and demanded money at the Sutton Hill Apartments, 2100 S.E. King Ave. The suspect, Kenneth Jimmerson, 19, was arrested when he later called for medical help. Jimmerson, who police say suffered at least three gunshot wounds, survived his injuries and faces a first-degree robbery charge. Melanie Stout, 18, who allegedly called in the pizza order, is charged with conspiracy. Spiers, who has a valid handgun permit, said it was the first time in 10 years on the job that he had been a robbery victim. Public reaction was immediate and overwhelmingly in favor of Spiers. But Vonnie Walbert, vice president of human resources at Pizza Hut’s corporate offices in Dallas, said earlier this month that employees are not allowed to carry guns ‘because we believe that that is the safest for everybody.’ … A state senator said he would stop buying Pizza Hut products if the pizza chain fired Spiers. The man grabbed a handgun and discovered two men inside his home in the 6100 block of Teague Drive, according to police. Remer was startled out of his sleep by some strange creaking noises he thought were caused by the wind. When he tried to open his door, he found it had been tied shut. … Then, Remer heard an unfamiliar voice in the hallway. He grabbed his .357 handgun from the closet and chased the intruder down the stairs and out the front door, firing several shots at their stolen SUV on the way out. Remer says he didn’t want to shoot the suspect in the back. He said since they gave him a break and didn’t do anything to him while he was sleeping, he wanted to make sure they saw his face if he pulled the trigger. When Remer went back into the house, he found a second suspect locked in a bedroom. ‘I said come on out — put your hands on your head, I’ll show you a little about Hanoi,’ Remer said, with a laugh.
